What the government said
The state's position, substantially accepted by the Supreme Court in June 2022, is that a mob attacked the train at Godhra and that the violence which followed was spontaneous rather than state-sponsored, that the administration moved as fast as an inadequate police force allowed and sought central forces and the Army promptly, and that the then Chief Minister made repeated public appeals for peace. The Court's 452-page judgment dismissing Zakia Jafri's appeal held there was no material worth the name to suspect a pre-planned conspiracy at the highest level, that inaction by some officials could not by itself establish a meeting of minds, that no fault could be found with the SIT's approach, and that the testimony of three officials was 'replete with falsehood'.

In July 2002 the National Human Rights Commission found a 'comprehensive failure on the part of the State Government to control the persistent violation of the rights to life, liberty, equality and dignity of the people of that State', and recommended five cases be transferred to the CBI. The state government declined, and without its request the Centre said the CBI could not take over. The Supreme Court twice found a fair trial impossible in Gujarat and moved cases out of the state: nine of the twenty-one Best Bakery accused were convicted only on retrial in Mumbai, after all had been acquitted at home. Convictions followed at Sardarpura, Ode, Naroda Patiya and Gulberg Society, and many did not survive appeal. In 2024 the Supreme Court quashed Gujarat's remission of the eleven Bilkis Bano convicts, holding the state was not the competent government and had 'acted in tandem and was complicit' with them. Across twenty-four years, no minister resigned.
