What happened

On 7 August 2025 the Leader of the Opposition, Rahul Gandhi, alleged at a press conference that 1,00,250 votes had been stolen in the Mahadevapura segment of Bangalore Central, breaking the figure into duplicate voters, invalid addresses, bulk registrations at single addresses, invalid photographs and misuse of Form 6. The Election Commission called the analysis misleading and false. The Chief Electoral Officers of Karnataka, Maharashtra and Haryana asked him to sign a declaration under Rule 20(3)(b) of the Registration of Electors Rules naming the electors concerned. He refused, saying his word in public could be taken as an oath. On 17 August the Chief Election Commissioner gave him seven days to file an affidavit or apologise to the nation.

What the government said

The Commission's position is that the allegations are false and baseless, that the only lawful route is a signed declaration naming specific electors so that proceedings can begin, and that a false declaration is itself punishable. It notes no election petition was filed within the statutory 45-day window and no evidenced objection was filed with the Maharashtra CEO, that the Maharashtra additions reflect routine summary revision and youth enrolment with figures already supplied to the Congress by letter in December 2024, that disclosure of who voted is barred by the Conduct of Election Rules, and that an exercise involving more than a crore staff cannot be quietly rigged. It asks whether 1.5 lakh voters should be served notice without evidence.

Not one of the five sub-figures has been examined by any independent body. The Commission declined to release machine-readable electoral rolls or polling-station CCTV footage that could settle the question, citing voter privacy. It has not explained why a ruling-party MP who made comparable roll-discrepancy claims about Rae Bareli was never asked for an affidavit. The constitutional expert P.D.T. Achary has said Rule 20(3)(b) governs claims and objections in the window after a draft roll is published and cannot apply after an election, which would mean the only route the Commission offered does not exist. The allegation and the rebuttal both remain untested, which serves whoever is wrong.

Contested / alleged

That votes were stolen, that the Commission colluded with any party, or that evidence was destroyed are allegations by the Leader of the Opposition and remain unproven. The Commission denies them in full and no court has made any such finding. The Supreme Court upheld the validity of the Special Intensive Revision of rolls in May 2026.

What accountability should have looked like

Machine-readable rolls published with personal data redacted, an independent audit of one contested segment to settle the method, and a single evidentiary standard applied to every party that alleges a discrepancy.
