What happened

The Citizenship Amendment Act amended the 1955 law to fast-track citizenship for non-Muslim migrants, Hindu, Sikh, Buddhist, Jain, Parsi and Christian, who entered from Pakistan, Bangladesh or Afghanistan before 31 December 2014. For the first time in independent India, religion became a criterion in naturalisation. The rules were notified in March 2024, more than four years later, just before the general election.

What the government said

The government says the law is purely humanitarian, offers refuge to persecuted minorities, takes away no Indian's citizenship, and that mere under-inclusion of a group is no ground to strike a law down.

The law was pushed through amid the largest protests in years, met with police crackdowns and, in places, deadly violence, and paired with talk of a nationwide NRC that raised the spectre of a documentation trap with a religious escape hatch open to some communities and shut to Muslims. The government has faced no reckoning for the protest deaths, sat on the rules for over four years and then rushed them out on the eve of an election, and the constitutional questions remain unresolved in court while the divisions it opened harden.

Contested / alleged

The claim that the CAA is unconstitutional and discriminates on religion, violating Articles 14 and 21, is the case made by around 230 petitioners and is pending before the Supreme Court, which has declined to stay the law and set final hearings for 2026. It has not been adjudicated.

What accountability should have looked like

A religion-neutral asylum and refugee framework that shelters anyone facing persecution on the evidence of their plight, not the label of their faith, meeting the humanitarian aim without dividing citizenship along sectarian lines.
